Agreement of Rules

Please read these rules before entering Freebird Stores Inc. “La Cantera Grand Opening Shoe Giveaway” 2022 contest. You agree that by entering this contest you will be bound by these Official Contest Rules and you acknowledge that you satisfy all contest eligibility requirements. In addition, you agree to accept the decisions of Freebird Stores Inc. as final and binding as it relates to the content of this campaign. 

Eligibility

This Contest is limited to all present entrants from 4PM to 7:30PM CST on September 29th, 2022. Entrants must be at least 18 years of age. The Promotion is subject to all applicable federal, state, provincial, municipal, territorial, and local laws and regulations. Participation constitutes the entrant’s full and unconditional agreement to these Official Rules and Sponsor’s decisions, which are final and binding in all matters related to the Promotion. Winning a prize is contingent upon fulfilling all requirements set forth herein.

This contest is sponsored by Freebird Stores Inc. located at 12655 E 42nd Ave Suite #50, Denver, CO 80239.

Timing

This contest begins on September 29th at 4 PM CST and reoccurs every 15 minutes. Freebird Stores server is the official time-keeping device for the promotion This contest ends at 7:30 PM CST on September 29th.

Prize

Every 15 minutes, one winner will be randomly chosen from the eligible entries. Winners will be posted every 15 minutes on our site starting at 4 PM CST on September 29th, 2022. Each chosen winner of the campaign will receive one FREE Freebird item. (This item must be in stock at our Boston location at 201 Newbury Street at the time of shopping) *Please note accessories are excluded

Prizes cannot be transferred, exchanged, redeemed in-store or for cash, or substituted by the winner. Freebird makes no representation or warranty concerning the appearance, safety, or performance of any prize awarded. Freebird will not replace any lost or stolen prize items. 

*Winner is eligible for one adjustment (exchange, sizing, color, warranty, repair, within our return policy)

Winner Selection and Notification

Each drawing will take place every 15 minutes on September 29th, 2022. For each drawing, Freebird Stores will randomly select one (1) potential prize winner from all eligible entries received during the respective entry period. The odds of winning in any entry period will depend on the total number of eligible entries received during the entry period. Each winner is considered a potential winner pending verification of his/her eligibility and compliance with these Official Rules. 

The potential winner(s) will be notified via announcement at Boston Store location. The winner must claim prize before next winner is announced. Freebird Stores Inc. shall have no liability for Winner's failure to receive notices due to spam, junk email, or other security settings or for Winner’s provision of incorrect or otherwise non-functioning contact information. 

Rights Granted by You

By entering this contest (e.g., photo, video, text, etc.), You understand and agree that Freebird Stores Inc, shall have the right, where permitted by law, to print, publish, broadcast, distribute, and use in any media now known or hereafter developed, in perpetuity and throughout the World, without limitation, your entry, name, portrait, picture, voice, likeness, image, statements about the Campaign, and biographical information for news, publicity, information, trade, advertising, public relations, and promotional purposes. without any further compensation, notice, review, or consent. Optional verbiage for Contests: By entering this contest, You represent and warrant that your entry is an original work of authorship, and does not violate any third party’s proprietary or intellectual property rights. If your entry infringes upon the intellectual property right of another, You will be disqualified at the sole discretion of Freebird Stores. If the content of your entry is claimed to constitute an infringement of any proprietary or intellectual proprietary rights of any third party, You shall, at your sole expense, defend or settle against such claims. You shall indemnify, defend, and hold harmless Freebird Stores from and against any suit, proceeding, claims, liability, loss, damage, costs, or expense, which Freebird Stores may incur, suffer, or be required to pay to arise out of such infringement or suspected infringement of any third party’s right.

General Conditions

Freebird Stores Inc reserves the right to cancel, suspend and/or modify the Promotion, or any part of it, if any fraud, technical failures, human error, or any other factor impairs the integrity or proper functioning of the Promotion, as determined by in its sole discretion. Freebird reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Promotion or to be acting in violation of the Official Rules of this or any other promotion or an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately undermine the legitimate operation of the Promotion may be a violation of criminal and civil law, and, should such an attempt be made, Freebird reserves the right to seek damages from any such person to the fullest extent permitted by law. 

Entry must be made by the entrant, only at the Entry Site. Entries made by any other individual or any entity, and/or originating at any other Internet website or email address, including but not limited to subscription notification and/or entering service sites, will be declared invalid and disqualified for this Contest. The use of any device to automate the entry process is prohibited.

Limitation of Liability

The Released Parties are not responsible for: (1) any incorrect or inaccurate information, whether caused by entrants, printing errors, or by any of the equipment or programming associated with or utilized in the Promotion; (2) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (3) unauthorized human intervention in any part of the entry process or the Promotion; (4) technical or human error which may occur in the administration of the Promotion or the processing of entries; (5) late, lost, undeliverable, damaged or stolen mail; or (6) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Promotion or receipt or use or misuse of any prize. If for any reason an entrant’s entry is confirmed to have been erroneously deleted, lost, or otherwise destroyed or corrupted, the entrant's sole remedy is another entry in the Promotion, if it is possible. If the Promotion, or any part of it, is discontinued for any reason, Sponsor, at its discretion, may elect to hold a random drawing from among all eligible entries received up to the date of discontinuance for any or all of the prizes offered herein. No more than the stated number of prizes will be awarded. If production, technical, seeding, programming, or any other reasons cause more than the stated number of prizes as outlined in these Official Rules to be available and/or claimed, Sponsor reserves the right to award only the stated number of prizes by a random drawing among all legitimate, un-awarded, eligible prize claims.

Any personally identifiable information collected during an Entrant's participation in the La Cantera Grand Opening Shoe Giveaway will be collected by Sponsor and used by Sponsor, for marketing purposes. Each Entrant agrees to the collection, processing and storage of Entrant's personal data by Sponsor.
