Freebird is the data controller of the personal data collected and is responsible for the processing of your personal data.

This Policy explains our practices with respect to the personal data we collect and process about you. This includes information we collect through, or in association with, our website with a home page located at www.freebird.com, including any subpages, our apps that we may provide, our products and services that we may offer from time to time via our website and/or related apps (collectively, as applicable, the “Website”), our retail stores, our related social media sites, or otherwise through your interactions with us (collectively, the “Services”). If you are accessing the Website on behalf of an organization, government entity, governing body, institution, or company, by your continued use of the Website you represent that you have the legal authority to bind any such organization, government entity, governing body, institution, or company to this Policy and ensure compliance herewith.

By using any of our Services, whether by visiting our website or otherwise, and/or by voluntarily providing personal data to us, you acknowledge that you have read and understand the practices contained in this Policy. PERSONAL DATA WE COLLECT

We gather the basic information including, but not limited to, Personally Identifiable Information (“PII”) you give us and what we learn from your visit to the Website, as explained in more detail in this Policy, and we and our affiliates and business partners use such information to fulfill the purpose of your interaction with us and as otherwise described in this Policy.

By submitting an email address or otherwise submitting content on the Website, you agree to receive marketing emails and other information that may be of interest to you from us. You may opt-out of receiving emails at any time by clicking the unsubscribe link at the bottom of each email. If you are a resident of the country of Canada, you also acknowledge that opting-in to receive emails is not a condition of entering into a transaction with us.

We reserve the right, at our discretion, to change, modify, add, or remove portions of this Policy at any time. If we intend to collect additional categories of personal data or use such data in a way that materially differs from this Policy, including but not limited to, sharing such information with more third parties, we will post such changes on this page and provide you with a new notice at or before the time of collection, as well as the opportunity to opt-out of such differing uses. The date this policy was last revised is identified at the top of the Policy. Please check this Policy frequently for updates. Your continued use of the Website and Services following the posting of any changes to this Policy constitutes your acceptance of such changes.

 

CHILDREN’S PRIVACY (COPPA NOTICE)
The Children’s Online Privacy Protection Act (“COPPA”) requires us to inform parents and legal guardians about our practice for collecting, using, and disclosing personal information from any users under the age of 13 (“children”). It also requires us to obtain verifiable consent from a child’s parent for certain collection, use, and disclosure of the child’s personal information. This section only applies to children under the age of 13 and supplements the other provisions of this Policy.

Any child-related data processed through the Website must be submitted only by authorized adults (e.g., providers, parents, or guardians). Users agree to comply with all applicable child privacy laws when entering or managing child data.

The Company does not knowingly collect personal information directly from children under 13. Any information relating to a child must be provided by a parent, guardian, or authorized provider. NON-PERSONAL OR AGGREGATE INFORMATION THAT WE COLLECT
When you access the Website, we may automatically collect non-PII from you. We may also aggregate demographic information collected from our users (such as the number of users in a particular geographical location) in a manner that does not identify any one individual to fulfill purposes such as tracking user growth. We may also aggregate information collected offline, obtain non-personally identifiable information from third party sources, and develop aggregate information by anonymizing previously collected PII.

It is possible at times when collecting non-PII through automatic means that we may unintentionally collect or receive PII that is mixed in with the non-PII. While we will make reasonable efforts to prevent such incidental data collection in this process, the possibility still exists. HOW WE USE YOUR PERSONAL DATA

  • Providing, predicting, or performing, including creating, maintaining, or servicing accounts, providing customer service, processing or fulfilling orders and transactions, verifying customer information, and processing payments.
  • Marketing our products and services to you, including sending you messages about the products and services we offer, which may include contests, rewards, sweepstakes, loyalty programs, events, and special offers for products and services. These communications may be tailored based on the communications preferences you select when providing us with your information or your activity on the Services, such as an abandoned cart, and will only occur with your prior consent, if such consent is required in accordance with applicable laws.
  • Promoting, advertising, and personalizing your online experience and the advertisements you see when you use the Services or third-party platforms based on your preferences, interests, purchasing history, and browsing behavior.
  • Profiling and Automated Decision Making. Except to the extent personal data is used by third-party ad networks for online behavioral advertising, neither we nor service providers on our behalf, engage in profiling or automated decision-making activities that produce legal and/or similarly significant effects upon you.
  • Furthering the purpose for which you provided such information by sharing or storing it with third parties (collectively “Third Party Vendors”). We urge you to read the privacy practices of all of our Third Party Vendors before submitting any PII through the Website.
  • Conducting or administering surveys and studies for market research purposes, including contacting you about responding to or participating in our surveys or studies.
  • Communicating with you by email, mail, text message (SMS, MMS), telephone, push notification, and other methods of communication, about products, services, new website features, order status, market research opportunities, and information tailored to your requests, comments, suggestions or inquiries.

We use analytics systems and providers and participate in ad networks that process personal data about your online activities over time and across third-party websites or online services, and these systems and providers may provide some of this information to us. We do not currently process or comply with any web browser’s “do not track” signal or similar mechanisms.

 

ANALYTICS AND CONVERSION TRACKING
We may use analytics services that use cookies, JavaScript, and similar technologies to help us analyze how users use the Website. The information generated by these services about your use of the Website (including, but not limited to, your internet protocol address (“IP Address”) or a truncated version of your IP Address) is transmitted to and stored by analytics service providers on their servers. Those service providers will use this information for the purpose of evaluating your, and other users’, use of the Website, compiling reports for us on Website activity and providing other services relating to Website activity and internet usage.

We may collect information about your computer or your mobile device, including, but not limited to, your IP Address, operating system, and browser type, for system administration and for the purpose of creating informational reports. This is statistical data about our users’ browsing actions and patterns and does not identify any individual.

 

AUTOMATICALLY COLLECTED INFORMATION
When you access the Website or open one of our HTML emails, we may automatically record certain information from your system by using cookies and other types of tracking technologies.   • No mobile or messaging consent information will be shared with third parties/affiliates for marketing/promotional purposes. All the above categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

 

YOUR RIGHTS REGARDING PERSONAL DATA
You have certain rights regarding the collection and processing of personal data. We do not control third parties’ collection or use of your information to serve interest-based advertising. However, these third parties may provide you with ways to choose not to have your information collected or used in this way. You can opt out of receiving targeted ads from members of the Network Advertising Initiative (“NAI”) on the NAI’s site.

Several other states (including, but not limited to: Colorado, Connecticut, Delaware, Florida, Indiana, Iowa, Montana, Oregon, Tennessee, Texas, Utah, and Virginia) have enacted state privacy laws to provide their state residents with rights such as:

ACCESSING, MODIFYING, DELETING, AND CORRECTING COLLECTED PERSONAL DATA
We strive to maintain the accuracy of any personal data collected from you, and will try to respond promptly to update our records when you tell us the information in our records is not correct. However, we must rely upon you to ensure that the information you provide to us is complete, accurate, and up-to-date, and to inform us of any changes. Please review all of your information carefully before submitting it to us, and notify us as soon as possible of any updates or corrections.

Depending on the laws that apply to you, you may obtain from us certain personal data in our records. If you wish to access, review, or make any changes to personal data you have provided to us through the Services, please contact us at the information provided at the end of this Policy. We reserve the right to deny access as permitted or required by applicable law.

Only you, or someone legally authorized to act on your behalf, may make a request to know or delete related to your personal information. You may, however, make a request to know or delete on behalf of your child. You may only submit a request to know or delete for the same person twice within a 12-month period. We cannot respond to your request or provide you with personal information if we cannot verify your identity or authority to make the request and confirm the personal information relates to you. We will only use personal information provided in the request to verify the requestor’s identity or authority to make it.

Your request to know or delete must:

  • Provide sufficient information that allows us to reasonably verify you are the person about whom we collected personal information or an authorized representative, which may include, but shall not be limited to: the type of information given; approximate dates when such personal information was requested; where the data was collected.
  • Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.

You do not need to create an account with us to submit a request to know or delete. However, we do consider requests made through your password protected account sufficiently verified when the request relates to personal information associated with that specific account. If you have an account with us, you may also review, update, modify, and delete your account information, including profile, contact, payment, and shipping information, at any time by logging into your account. You may also deactivate your account by emailing orders@freebirdstores.com.

Once we receive your request and confirm your identity, we will review your request to see if an exception allowing us to retain the information applies. We may deny your deletion request if retaining the information is necessary for us or our service provider(s) to:

  • Complete the transaction for which we collected the personal information, provide a good or service that you requested, take actions reasonably anticipated within the context of our ongoing business relationship with you, fulfill the terms of a written warranty or product recall conducted in accordance with federal law, or otherwise perform our contract with you.
  • Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, or prosecute those responsible for such activities.
  • Debug products to identify and repair errors that impair existing intended functionality.
  • Exercise free speech, ensure the right of another consumer to exercise their free speech rights, or exercise another right provided for by law.
  • Comply with any applicable law or any legal obligation.
  • Engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when the information’s deletion may likely render impossible or seriously impair the research’s achievement, if you previously provided informed consent.
  • Enable solely internal uses that are reasonably aligned with consumer expectations based on your relationship with us.
  • Make other internal and lawful uses of that information that are compatible with the context in which you provided it.

We will confirm receipt of your request to know or request to delete within ten business days. We endeavor to substantively respond to a verifiable consumer request within forty-five days of its receipt. If we require more time (up to another forty-five days), we will inform you of the reason and extension period in writing. If you have an account with us, we will deliver our written response to that account. If you do not have an account with us, we will deliver our written response by mail or electronically, at your option.

Any disclosures we provide will only cover the 12-month period preceding our receipt of your request. The response we provide will also explain the reasons we cannot comply with a request, if applicable.

 

YOUR CALIFORNIA PRIVACY RIGHTS
If you are a California resident, California law may provide you with additional rights regarding our use of your personal information. To learn more about your California privacy rights under the California Consumer Privacy Act of 2018 (“CCPA”), visit https://oag.ca.gov/privacy/ccpa. Rights available to California residents include:

  • The right to rectify. You have the right to request that we correct any information you believe is inaccurate. You also have the right to request us to complete information you believe is incomplete.
  • The right to erasure. You have the right to request us to erase your personal information.
  • The right to restrict processing. You have the right to request that we restrict the processing of your personal information.
  • The right to object to processing. You have the right to object to our processing of your personal information.
  • The right to data portability. You have the right to request that we transfer the data we collect to another organization, or directly to you.

We will not discriminate against you for exercising any of your CCPA rights. Unless permitted by the CCPA, we will not, because of your exercise of any of your CCPA rights:

  • Deny you goods or services.
  • Charge you different prices or rates for goods or services, including, but not limited to, through granting discounts or other benefits, or imposing penalties.
  • Provide you a different level or quality of goods or services.
  • Suggest that you may receive a different price or rate for goods or services or a different level or quality of goods or services.

California’s “Shine the Light” law (Civil Code Section § 1798.83) permits users of the Website that are California residents to request certain information regarding our disclosure of personal information to third parties for their direct marketing purposes. Additional Child Protections Under the California Consumer Privacy Act

California minors are protected by the Eraser Law, also known as the Privacy Rights for California Minors in the Digital World Act as well as the California Children’s Code. These laws extend protections to all minors under the age of eighteen (18).

 

YOUR NEVADA PRIVACY RIGHTS
Nevada law permits our users who are Nevada consumers to request that their personal data not be sold (as defined under applicable Nevada law), even if their personal data is not currently being sold. Requests may be sent to the email to orders@freebirdstores.com and are free of charge.

 

YOUR EUROPEAN UNION AND UNITED KINGDOM PRIVACY RIGHTS
In addition to the above-listed rights, the General Data Protection Regulation ((EU) 2016/679), the “GDPR”) provides residents of the European Economic Area with enhanced rights in respect of their personal data. The UK General Data Protection Regulation governs the rights of individuals residing in the United Kingdom. These rights may include, depending on the circumstances surrounding the processing of personal data:

  • The right to request that we provide you with copies of your personal information;
  • The right to request that we correct any information you believe is inaccurate. You also have the right to request us to complete information you believe is incomplete;
  • The right to object to decisions based on profiling or automated decision making that produce legal or similarly significant effects on you;
  • The right to request restriction of processing of personal data or object to processing of personal data carried out pursuant to (i) a legitimate interest (including, but not limited to, processing for direct marketing purposes) or (ii) performance of a task in the public interest;
  • In certain circumstances, the right to data portability, which means that you can request that we provide certain personal data we hold about you in a machine-readable format to another organization, or directly to you; and
  • In certain circumstances, the right to erasure and/or the right to be forgotten, which means that you can request deletion or removal of certain personal data we process about you.

If you made a request pursuant to your rights under the GDPR, we have one month to respond to you. If you have an account with us, you may also review, update, and delete certain personal data by logging into your account.

 

YOUR CANADIAN PRIVACY RIGHTS
Residents of Canada are permitted to request and obtain from us information respecting the existence, use, and disclosure of their personal data as well as access to that information (subject to certain exceptions pursuant to applicable laws). Without limiting the above, residents of Canada will, upon request:

  • Be informed of whether we hold personal data about you;
  • Be provided with an account of third parties to which we have disclosed your personal data;
  • Be able to challenge the accuracy and completeness of your personal data and have it amended as appropriate; and

When you are asked to provide information, you may decline to do so; but if you choose not to provide information that is necessary to provide some of our Services, you may not be able to use those Services. ANY CLAIM, DISPUTE, OR CONTROVERSY (WHETHER IN CONTRACT, TORT, OR OTHERWISE, WHETHER PRE-EXISTING, PRESENT, OR FUTURE, AND INCLUDING, BUT NOT LIMITED TO, STATUTORY, CONSUMER PROTECTION, COMMON LAW, INTENTIONAL TORT, INJUNCTIVE, AND EQUITABLE CLAIMS) BETWEEN YOU AND US ARISING FROM OR RELATING IN ANY WAY TO THE SITE OR THE CONTENT WILL BE RESOLVED EXCLUSIVELY AND FINALLY BY BINDING ARBITRATION IN THE CITY OF DENVER, COLORADO.

The arbitrator will be empowered to grant whatever relief would be available in court under law or in equity. Any award of the arbitrator(s) will be final and binding on each of the parties and may be entered as a judgment in any court of competent jurisdiction.

You agree to arbitration on an individual basis. In any dispute, NEITHER YOU NOR WE WILL BE ENTITLED TO JOIN OR CONSOLIDATE CLAIMS BY OR AGAINST OTHER CUSTOMERS IN COURT OR IN ARBITRATION OR OTHERWISE PARTICIPATE IN ANY CLAIM AS A CLASS REPRESENTATIVE, CLASS MEMBER, OR IN A PRIVATE ATTORNEY GENERAL CAPACITY. The arbitral tribunal may not consolidate more than one person’s claims and may not otherwise preside over any form of a representative or class proceeding. The arbitral tribunal has no power to consider the enforceability of this class arbitration waiver and any challenge to the class arbitration waiver may only be raised in a court of competent jurisdiction. If any provision of this arbitration agreement is found unenforceable, the unenforceable provision will be severed, and the remaining arbitration terms will be enforced.
