AGREEMENT OF RULES

Please read these rules before entering Freebird Stores Inc. “Win Free Boots for Life” 2024 contest. You agree that by entering this contest you will be bound by these Official Contest Rules and you acknowledge that you satisfy all contest eligibility requirements. In addition, you agree to accept the decisions of Freebird Stores Inc. as final and binding as it relates to the content of this campaign.

ELIGIBILITY

This Contest is limited to legal residents of the 50 United States of America. Entrants must be at least 18 years of age. The Promotion is subject to all applicable federal, state, provincial, municipal, territorial and local laws and regulations. Participation constitutes the entrant’s full and unconditional agreement to these Official Rules and Sponsor’s decisions, which are final and binding in all matters related to the Promotion. Winning a prize is contingent upon fulfilling all requirements set forth herein. Any submissions made through automation will be disqualified.

TIMING

This contest begins on December 4th, 2023 at 12:00 AM MST. Freebird Stores server is the official time-keeping device for the promotion. This contest ends at 11:59 PM MST on January 31st, 2024.

Contest Ends January 31st, 2024. Winner announced February 1st, 2024.   

PRIZE

The winner of the campaign will receive one FREE pair of boots each year for a total of 15 years, starting February 1st, 2024. (The boot must be in stock on our online site at the time of shopping.) Prizes cannot be transferred, exchanged, redeemed in-store or for cash, or substituted by the winner.

*Winner is eligible for an adjustment (exchange, sizing, color, warranty, repair, within our return policy)

ODDS

The odds of winning depend on the number of participants entered and are chosen at random at the end of the contest period.

WINNER SELECTION & NOTIFICATION

The winner will be selected at random on January 31st, 2024. The winner will be notified via email on February 1st, 2024. The winner will be given 48 hours to claim the prize. Freebird Stores Inc. shall have no liability for the Winner's failure to receive notices due to spam, junk email or other security settings or for the Winner’s provision of incorrect or otherwise non-functioning contact information.

RIGHTS GRANTED BY YOU

By entering this contest (e.g., photo, video, text, etc.), You understand and agree that Freebird Stores Inc, shall have the right, where permitted by law, to print, publish, broadcast, distribute, and use in any media now known or hereafter developed, in perpetuity and throughout the World, without limitation, your entry, name, portrait, picture, voice, likeness, image, statements about the Campaign, and biographical information for news, publicity, information, trade, advertising, public relations, and promotional purposes without any further compensation, notice, review, or consent. Optional verbiage for Contests: By entering this contest, You represent and warrant that your entry is an original work of authorship, and does not violate any third party’s proprietary or intellectual property rights. If your entry infringes upon the intellectual property right of another, You will be disqualified at the sole discretion of Freebird Stores Inc. If the content of your entry is claimed to constitute an infringement of any proprietary or intellectual proprietary rights of any third party, You shall, at your sole expense, defend or settle against such claims. You shall indemnify, defend, and hold harmless FREEBIRD STORES from and against any suit, proceeding, claims, liability, loss, damage, costs, or expense, which FREEBIRD STORES may incur, suffer, or be required to pay to arise out of such infringement or suspected infringement of any third party’s right. 

GENERAL CONDITIONS

Freebird Stores Inc. reserves the right to cancel, suspend and/or modify the Promotion, or any part of it, if any fraud, technical failures, human error, or any other factor impairs the integrity or proper functioning of the Promotion, as determined by in its sole discretion. Freebird reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Promotion or to be acting in violation of the Official Rules of this or any other promotion or an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately undermine the legitimate operation of the Promotion may be a violation of criminal and civil law, and, should such an attempt be made, Freebird Stores Inc. reserves the right to seek damages from any such person to the fullest extent permitted by law. Entry must be made by the entrant, only at the Entry Site. Entries made by any other individual or any entity, and/or originating at any other Internet website or email address, including but not limited to subscription notification and/or entering service sites, will be declared invalid and disqualified for this Contest. The use of any device to automate the entry process is prohibited.

LIMITATION OF LIABILITY

The Released Parties are not responsible for: (1) any incorrect or inaccurate information, whether caused by entrants, printing errors, or by any of the equipment or programming associated with or utilized in the Promotion; (2) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (3) unauthorized human intervention in any part of the entry process or the Promotion; (4) technical or human error which may occur in the administration of the Promotion or the processing of entries; (5) late, lost, undeliverable, damaged or stolen mail; or (6) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, fro

m entrant’s participation in the Promotion or receipt or use or misuse of any prize. If for any reason an entrant’s entry is confirmed to have been erroneously deleted, lost, or otherwise destroyed or corrupted, the entrant’s sole remedy is another entry in the Promotion, if it is possible. If the Promotion, or any part of it, is discontinued for any reason, Sponsor, at its discretion, may elect to hold a random drawing from among all eligible entries received up to the date of discontinuance for any or all of the prizes offered herein. No more than the stated number of prizes will be awarded. In the event that production, technical, seeding, programming, or any other reasons cause more than the stated number of prizes as set forth in these Official Rules to be available and/or claimed, Sponsor reserves the right to award only the stated number of prizes by a random drawing among all legitimate, un-awarded, eligible prize claims.

DISPUTES

This contest is governed by the laws of Denver County and the state of Colorado, without respect to conflict of law doctrines. As a condition of participating in this Campaign, the participant agrees that any and all disputes that cannot be resolved between the parties, and causes of action arising out of or connected with this Campaign, shall be resolved individually, without resorting to any form of class action, exclusively before a court located in Colorado / 

Denver County has jurisdiction. Further, in any such dispute, under no circumstances shall the participant be permitted to obtain awards for, and hereby waives all rights to, punitive, incidental, or consequential damages, including reasonable attorney’s fees, other than the participant’s actual out-of-pocket expenses (i.e. costs associated with entering this Campaign). Participant further waives all rights to have damages multiplied or increased. Void where prohibited.
