AGREEMENT OF RULES 

Please read these rules before entering Freebird Stores Inc. NASHVEGAS Getaway 2024. You agree that by entering this contest you will be bound by these Official NASHVEGAS Getaway Rules, and you acknowledge that you satisfy all contest eligibility requirements. In addition, you agree to accept the decisions of Freebird Stores Inc. as final and binding as it relates to the content of this campaign. 
 
By entering this contest, you hereby agree to our email marketing and SMS.  

ELIGIBILITY 

This contest is limited to legal residents of the 50 United States of America. Entrants must be at least 21 years of age. The Promotion is subject to all applicable federal, state, provincial, municipal, territorial, and local laws, and regulations. Participation constitutes the entrant’s full and unconditional agreement to these Official Rules and Sponsor’s decisions, which are final and binding in all matters related to the Promotion. Winning a prize is contingent upon fulfilling all requirements set forth herein.

TIMING 

This contest will run from midnight (MST) 4/26/2024 to 11:59 am (MST) 5/31/2024. The winner will be announced on 6/01/2024 and must travel between 06/01/2024 and 08/31/2024. Freebird Stores, Inc. server is the official time-keeping device for the promotion. 

HOW TO ENTER 

Freebird Stores Inc NASHVEGAS 2024 Getaway Contest will be measured and powered by Freebird Stores, Inc.  
 
1. Sign in or create an account at FreebirdStores.com on the NASHVEGAS Getaway page.  

2. Enter name, email, and set home store.  

3. Follow @FreebirdStores or @OriginalFreebird on Instagram & Facebook. 

4. Tag a friend on any competition post (1 comment = 1 entry). 

PRIZE   

The winner and two guests will each receive one free pair of Freebird footwear of their choice (styles must be in stock at the time of in-store visit). In addition, two E-gift cards in total will be awarded - one e-gift card valued at $1500, for domestic airfare with Delta Airlines as well as one e-gift valued at $750 for a 3-day, 2-night hotel stay within the US Marriott. The winner and the two selected friends must travel from 06/01/2024 - 08/31/2024. Travel must be within the contiguous United States. 

*Prizes cannot be transferred, redeemed for cash or substituted by the winner. Sponsor makes no representation or warranty concerning the appearance, safety or performance of any prize awarded. Sponsor will not replace any lost or stolen prize items.  

*All travel-related expenses, including, but not limited to, ground transportation to and from home, taxes, gratuities, incidentals, upgrades, insurance, service charges, airport surcharges, departure taxes, hotel, resort or property fees, luggage fees, food and beverage, and personal expenses are the sole responsibility of Winner and/or Guests. Winner and Guests must travel on same itinerary.

The odds of winning depend on the number of entry(s)/participants received at the end of the contest period. 

WINNER SELECTION AND NOTIFICATION 

The participant will be randomly selected at 11:59 am (MST) 5/31/2024 and announced 06/01/2024 on our website (FreebirdStores.com) and through our social channels (Facebook and Instagram). The winner will be notified via email within a day (1) after the selection.   

Freebird Stores Inc. will have no liability for Winner's failure to receive notices due to spam, junk email, or other security settings or for Winner’s provision of incorrect or otherwise non-functioning contact information. If the potential winner fails to respond within seven (7) days of the initial email, an alternate winner will be selected in a random drawing among all remaining eligible entries.  

RIGHTS GRANTED BY YOU 

By entering this contest, you will grant Freebird Stores Inc. access to a copy of your flight and hotel booking within 10 days of the announcement. You understand and agree that Freebird Stores Inc., shall have the right, where permitted by law, to print, publish, broadcast, distribute, and use in any media (e.g., photo, video, text, etc.) now known or hereafter developed, in perpetuity and throughout the World, without limitation, your entry, name, portrait, picture, voice, likeness, image, statements about the Campaign, and biographical information for news, publicity, information, trade, advertising, public relations, and promotional purposes. Without any further compensation, notice, review, or consent. Optional verbiage for Contests: By entering this content, you represent and warrant that your entry is an original work of authorship and does not violate any third party’s proprietary or intellectual property rights. If your entry infringes upon the intellectual property right of another, you will be disqualified at the sole discretion of Freebird Stores Inc. If the content of your entry is claimed to constitute infringement of any proprietary or intellectual proprietary rights of any third party, you shall, at your sole expense, defend or settle against such claims. You shall indemnify, defend, and hold harmless Freebird Stores Inc. from and against any suit, proceeding, claims, liability, loss, damage, costs, or expense, which Freebird Stores Inc. may incur, suffer, or be required to pay arising out of such infringement or suspected infringement of any third party’s right. 

GENERAL CONDITIONS 

Freebird Stores Inc. reserves the right to cancel, suspend, and/or modify the Promotion, or any part of it, if any fraud, technical failures, human error, or any other factor impairs the integrity or proper functioning of the Promotion, as determined by Sponsor in its sole discretion. Sponsor reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Promotion or to be acting in violation of the Official Rules of this or any other promotion or in an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately undermine the legitimate operation of the Promotion may be a violation of criminal and civil law, and should such an attempt be made, the Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. 

LIMITATION OF LIABILITY 

The Released Parties are not responsible for (1) any incorrect or inaccurate information, whether caused by entrants, printing errors, or by any of the equipment or programming associated with or utilized in the Promotion; (2) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (3) unauthorized human intervention in any part of the entry process or the Promotion; (4) technical or human error which may occur in the administration of the Promotion or the processing of entries; (5) late, lost, undeliverable, damaged or stolen mail; or (6) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from the entrant’s participation in the Promotion or receipt or use or misuse of any prize. If for any reason an entrant’s entry is confirmed to have been erroneously deleted, lost, or otherwise destroyed or corrupted, the entrant's sole remedy is another entry in the Promotion, if it is possible. If the Promotion, or any part of it, is discontinued for any reason, the Sponsor, at its discretion, may elect to hold a random drawing from among all eligible entries received up to the date of discontinuance for any or all of the prizes offered herein. No more than the stated number of prizes will be awarded. If production, technical, seeding, programming, or any other reasons cause more than the stated number of prizes as outlined in these Official Rules to be available and claimed, the Sponsor reserves the right to award only the stated number of prizes by a random drawing among all legitimate, un-awarded, eligible prize claims. 

DISPUTES 

This contest is governed by the laws of Denver County and the state of Colorado, without respect to conflict of law doctrines. As a condition of participating in this Campaign, the participant agrees that any disputes that cannot be resolved between the parties and causes of action arising out of or connected with this Campaign shall be resolved individually, without resorting to any form of class action, exclusively before a court located in [your state/province] having jurisdiction. Further, in any such dispute, under no circumstances shall the participant be permitted to obtain awards for and hereby waives all rights to, punitive, incidental, or consequential damages, including reasonable attorney’s fees, other than the participant’s actual out-of-pocket expenses (i.e. costs associated with entering this Campaign). Participant further waives all rights to have damages multiplied or increased.
